Lawmaker Pushes for 50-50 Custody Reform in PA

May 12, 2025

If you’re facing a custody battle or navigating divorce in Pennsylvania, recent efforts by Rep. Jamie Flick could signal meaningful changes for parents and children alike. Flick is advocating for a 50-50 shared custody amendment that would make equal parenting time the starting point in custody decisions, unless one parent is proven unfit. While the amendment narrowly failed in a recent vote, it reflects growing momentum toward family court reform that prioritizes stability, fairness, and the well-being of children.

A Closer Look at Pennsylvania’s Proposed 50-50 Custody Amendment

Rep. Jamie Flick’s proposed amendment would have restructured Pennsylvania’s child custody laws to presume that 50-50 shared custody is in the best interest of the child, provided both parents are capable caregivers. Instead of weighing 19 separate factors — as is currently the case — courts would focus on three key considerations:

  • History of abuse
  • Level of conflict between parents
  • Willingness and ability to cooperate

Additionally, if a judge awarded less than equal parenting time, they would be required to explain their decision in writing.

Flick, who has personal experience with a painful custody battle, argues this change would help prevent unfair rulings and limit emotionally damaging outcomes for children. Research shows that children with access to both parents experience better long-term outcomes in education, mental health, and behavioral development.

Though the amendment was narrowly defeated in a 103-99 vote, bipartisan support signals potential for future progress in Pennsylvania’s family law landscape.

How These Changes Could Impact Custody Cases in Pennsylvania

While Pennsylvania has not yet adopted a presumption of 50-50 custody, Flick’s efforts highlight growing recognition of the importance of both parents in a child’s life post-divorce. Currently, mothers are awarded primary custody in 80% of cases, with fathers in Pennsylvania receiving, on average, just 28.2% of parenting time.
