What If I Don’t Have a Court-Ordered Child Support Agreement?

I Have a Court-Ordered Child Support Agreement, My Ex Still Isn’t Paying – Now What?

If you already have a court-ordered child support agreement, there are a few different actions you can take to get the order enforced. First, your LLF Law Firm attorney will send a demand to your ex; it serves as a formal reminder of their legal obligation and notifies them that you will take further legal action if they don’t pay up.

Sometimes the demand isn’t enough. Maybe your ex thought you were bluffing, or they think, for some reason, they are above the law, but now it’s time to get serious. One of our Family Law Team attorneys will file a motion of contempt with your Pennsylvania family court. A motion for contempt is used to ask a judge to enforce the child support agreement. If your ex still doesn’t pay, your LLF Law Firm attorney will request that the court take further action.

The judge can do a few things to enforce child support, whether as a response to the motion of contempt or subsequent filings, these include:

  • Requiring payment of child
  • Requiring your ex to pay interest on missed child support payments
  • Garnishing wages or pension payments

  • Seizing bank accounts
  • Suspend or revoke their driver’s license
  • Suspend or revoke their professional license (for example, electrician license, nursing license)
