PA Coalition Against Domestic Violence Sues Trump-Vance Administration
The Pennsylvania Coalition Against Domestic Violence (PCADV) and other domestic violence support groups in 16 other states filed a complaint against the Trump-Vance administration, challenging newly approved restrictions that could limit domestic or sexual violence survivors’ access to vital resources that previously helped victims.
The injunction, which aims to challenge the legality of the Trump administration’s actions, also seeks to put an immediate stop to the unfair restrictions on the grants that are typically disbursed by the Department of Justice’s Office on Violence Against Women (OVW).
This means that survivors of abuse in the home or elsewhere may struggle with obtaining help from domestic violence support agencies when necessary. What Can You Do If You’re a Victim of Domestic Violence or Sexual Abuse?
While waiting for the outcome of the lawsuit filed by the coalition, you need to get help if you’re a victim of domestic violence and sexual abuse. Call 911 to report the abuse and seek protection. Law enforcement agents can arrest and charge the abuser for their actions towards you.
Where necessary, they can help secure an emergency Protection From Abuse (PFA) order. This is usually issued over the weekend, overnight, or during the holidays when the court isn’t open. However, if you do not want to file a criminal case, you can still apply for a temporary Protection From Abuse order from the family law court in your county.
A temporary PFA typically expires within 10 days and doesn’t require the presence of the accused. Once you apply and it’s granted, the court will schedule a final PFA hearing within the said 10 days. During the final PFA hearing, the court will hear from both you and the defendant, if they appear.
The court requires a preponderance of evidence, meaning either party has more proof than the other, to either issue a final PFA or dismiss the case. Please note that if the defendant fails to appear, the court will automatically award the final or permanent PFA.
